SOUND SYSTEMS ON CAMPUS
It is important that individuals and groups in the University community respect others' rights by not creating noise disturbances on the campus or around residences. Whenever an event is scheduled, whether an amplified sound system is involved or not, the sponsoring organization must take into account the area being used and its potential for noise disturbance.
During the week, sound systems may be used on campus and around University residences only between the hours of 10:00 a.m. and 11:00 p.m. The use of sound systems during the weekend must be terminated by 1:00 a.m. on Saturday and Sunday mornings. The use of sound systems during the week (Sunday evening through Friday afternoon) is permitted in the Greek Theatre, on the lawn of Old Main, and in designated parking lots with prior approval from the Physical Plant. Sound systems may be used on the Arkansas Union bridge and Mall area with prior approval from the Director of the Arkansas Union, ARKU M-423. The intent is not to deny access to speakers or other presentations where noise spill creates no problem; rather, "noise pollution" is the target of this policy.
SOUND ORDINANCE
All students and student organizations at the University of Arkansas must comply with Fayetteville Code 13-811, known as the Sound Ordinance, which prohibits unreasonable sound disturbance, and states specifically:
No person shall operate or cause to be operated on private property any source of sound in such a manner as to create a sound level which exceeds the limit set for the receiving land use category when measured at or within the property boundary of the receiving land use.
The Ordinance includes tables which show the sound level limit, in decibels, for each category of receiving land use and for various times of day.
Among other specific prescriptions, the Ordinance provides:
No person shall sound any horn or other auditory signaling device on or in any motor vehicle on any public right-of-way or public place, except as a warning of danger.
Any group planning an outside event and/or a function involving the use of an amplified sound system on campus is expected to consult with the Dean of Students well in advance of the planned event for the purpose of assuring compliance with this ordinance.
Variances from the Sound Ordinance may be sought from the City Manager. If the City Manager denies a variance, an appeal may be made to the Fayetteville Board of Directors.
Any University of Arkansas student organization or living group seeking a variance from the Sound Ordinance must submit its proposal for variance on a designated form to the Office of Student Services which coordinates all such requests. The Dean of Students will review the proposal for reasonableness and compliance with University policy, including policies relating to noise and use of sound systems, and if deemed appropriate, will forward the proposal to the City Manager as required by the Ordinance. Student Services may recommend modification of the request, or withhold action pending acceptance of such modification. If the Office of Student Services determines that the request should not be forwarded to the City Manager, the organization may appeal to the Vice Chancellor for Student Services for a review of that decision.
Compliance with the above-outlined procedure and/or a decision by the Office of Student Services to refer a variance request to the City Manager does not indicate that the request will be approved by the City Manager of the Fayetteville Board of Directors.
